Business Trademark Registration

There are lots of employment opportunities in the market and after a few years of hard work many people earn sufficient sums to get their own business up and running.

What a self employed or self-run business provides is not what you get when you were an employee; you have complete freedom to decide what and how to run the company. Once you have a self-run company you aren't a slave in an organization that you have no ownership of.

There are many benefits of owning a self-run business. But getting a new business started up and running could be more complicated procedure than you would have 1st thought it to be. The 1st object of thought should be what you want to do or simply what is going to be the services or products of your new company. What you would also need to do is consider the viability of that business. Also thing such as business name, net profit & gross profit, expenses, the public, business location & also the trademark for your services & products.

Upon the entire fore mentioned thing coming in place you would want to getting moving with the formalities related to trademark. The trademark needs to be registered to be recognized by law and for that you will need to get the registration from the USPTO. This registration office is that where all matters related to trademarks & patents are taken care off. Matters related to copyrights are also dealt with here.

Well considering the fact that it is a lengthy route, you might think of the importance of registration. Primarily trademark is like telling people that you even exist and the products or services they are buying in the market place is from your company. There is no denying the importance of a trademark. You wouldn't want to be in an ugly situation where in you happen to go to a store looking for your own manufactured T-shirt and find that a same kind of T-shirt is being sold there and you cannot do anything about it as your product does not have a trademark registration.

The process of trademark filing at the registration office can be done alone or incase you feel the need for taking the services of a trademark & patent attorney that too can be done. The 1st step in that direction is to take a form for registration and then fill it up with the required information and then submit the application form to the registration office. It is the registration office that handles the job for granting or rejecting an application.

Incase a person's application for registering of a trademark meets the bare standard for registration that have been declared by the registration office, initially they shall allot you a serial number and this number is received by you in about 2 months time after submission of the application. But incase your application does not meet the bare minimum standard for registration, then all that you sent to them including the filing charges is retuned.

But that's not all and though you have a serial number from the USPTO you are not to make use of the symbol yet. Upon filing the application, thereafter in about 2 months time you can expect to get a postcard via USPTO wherein it states the receipt of that every application sent by you. Then for a period of 6-7 months do not expect to listen from them. The whole process is a lengthy one and take months together before they tell you that the application is accepted, incase they need any clarification of any matter then it is better that you respond to them within thirty to sixty days. And then you shall be told that your application has been approved, if it all takes place in a time frame below 1 year then consider yourself lucky.

In a high percentage of cases it happens to be that the symbol is accidentally or on purpose similar to symbols that have already been granted registration. What you then have to do is alter that same trademark you sent for approval in a manner that is bear's little or absolutely no resemblance to a trademark which happens to be already registered.

So, guess you have a fair idea of trademark registering now. Thus if you are planning on beginning a fresh business of your own then should think on the lines of the trademark to be used as well. You will have to ensure its uniqueness and that is bear's little or absolutely no resemblance to a trademark which happens to be already registered.
