Registered Trademark Rewards & the Process of Application

When you are about to start up a new business and that too a huge one, then there are a lot of things that you as a proprietor or owner would have to do, including permits for local business, meeting requirements of the state plus you shall have to complete all paper work that shall be required to get the business up and running. And an important part of that paper work would be to apply or register for a trademark.

Intellectual property is what a trademark is considered to being with regards to a person or a business. Incase you like to maintain your mark then trademark it. But getting one can be a lengthy process in which you need to keep patience.

Your business cannot be a success if you are not confident of its success. Ample amount of research and study is done to get a business running. And just in case your business is on the path of growth it will most probably call for a trademark, which could be in the shape of a brand, logo or something else also.

Obtaining a trademark isn't difficult. All you need to do is go to the USPTO office or even log on to the official website and gather the required information that is needed to apply for a trademark. The procedure is simple but time consuming. You surely need patience when you have applied to received trademark.

Initially you need to go through an extensive online search to ensure there no such trademark already registered. Hiring a professional will add to your surety. Then you go out to a fill the application and submit it to the USPTO, the office then will appoint an attorney who will evaluate your application and accept or reject the application. If there is any discrepancies found in the application in accordance to the standards of USPTO the same will be informed through correspondence. It's a Government department so a time lag is obvious.

Trademark registration is not a mandatory thing to do. But again it goes without saying that the benefits of a registered trademark is immense and those who have it will know well. Once you are having a registered trademark, all will be conscious of it and so will your competitors. Only fools will attempt to intervene in the affairs of your business as doing so makes them liable to face the ire of the courts as they have attempted against the laws of the land.

There are can be confusion with the service or the product that you are producing but when you have the trademark registration then there is no cause of worry. ® symbol is used to create your brand name identity, and thereby you state that you have elite rights for that product or service.

Upon filing the application, thereafter in about 2 months time you can expect to get a postcard via USPTO wherein it states the receipt of that every application sent by you. Then for a period of 6-7 months do not expect to listen from them. The whole process is a lengthy one and take months together before they tell you that the application is accepted, incase they need any clarification of any matter then it is better that you respond to them within thirty to sixty days. And then you shall be told that your application has been approved, if all this is over in a time frame of below 1 year then consider yourself to be extremely fortunate.

Thus incase you have sent an application to the USPTO and haven't heard from them in a long while then there is no cause for concern, this happens to be an office SOP. During this the business that you are involved in can be continued unabated. But you should have a trademark registered incase you want to maintain the edge for a long time.

Supposedly you happen to have entered a business wherein there are no trademarks that are awarded then you should be in the thought process of the consequences that might creep up due to the situation. You would not want to wait for something dreadful to take place, thus it is highly important that you send an application immediately and get these much needed safeguards.
