USPTO - Why Register A Trademark

Commerce is growing all around the world and there new start-ups everyday. New businesses mean there will be fresh business names, which in means the requirement of fresh trademarks. And for all these reasons today a business isn't truncated to having proper finances and a superb business plan.

As it stands today even if you make a success out of a new business in the competitive business environment you might just see everything going down the drain if you do not consider getting your business trademark registration

For a fresh business there needs to be a fresh idea of services or products, that is if you would like to be doing something different. And then if you want that fresh difference to be recognized and protected then you will require a trademark that sets to apart from the rest. By getting a trademark, there is an identity for your product and help the product have a separate identity.

Primarily trademark is like telling people that you even exist and the products or services they are buying in the market place is from your company. There is no denying the importance of a trademark. You wouldn't want to be in an ugly situation where in you happen to go to a store looking for your own manufactured T-shirt and find that a same kind of T-shirt is being sold there and you cannot do anything about it as your product does not have a trademark registration.

But it not that one fine day you have a dream and the design will fall in your laps and then it converts in a print on the products straight away. What you need to do as the 1st step in order to apply for a trademark registration is that you get a form and fill in the minimum requirements and fields that are indication in the form, once that is done you can proceed to submit the application to the registration office. By getting the approval for the trademark you have taken steps to protect your services or protects from any kind of infringement.

It is not mandatory that if you happen to have started a business or already doing one then you must also have a mark registered as being your trademark, there are many benefits of registering one. The 1st benefit is that you have claimed trademark ownership. The 2nd benefit when someone else happens to make use of a same or about similar of a trademark that is registered in your name sans your knowledge or approval then you have full rights to take legal action against that party and claim defamation charges.

You might have come across the use of signs SM, TM & "R" within a circle, then you would also like to know what they stand for. Whenever you would like to show your intent to declare a mark, at that time you can state so by the sue of SM or TM which shall let others know that you are claiming that particular mark, that too incase you even haven't filed an request of intent to use it. For the ® it means that the mark has previously been registered.

This can be done in accordance with USPTO laws.

As there are many new start-ups there are also many applications for registering a trademark and this is a very time consuming procedure. What you need to do as the 1st step in order to apply for a trademark registration is that you get a form and fill in the minimum requirements and fields that are indication in the form, once that is done you can proceed to submit the application to the registration office. The required fields shall be with regards to your address, name, along with a comprehensive sketch & narration of the mark. There is also an application fee that you have to pay.

In the case of the approval is received of the application, and then a USPTO personnel examines the same. The job of that personnel is to comprehensively search that whether or not such a similar or about similar trademark is already there or not. After some time or long time there shall be intimation to the approval or rejection of the application.

And then if you happen to be told that your application has been approved, if it all takes place in a time frame below 1 year then consider yourself lucky.
